What’s going on in Venezuela
- Opinión
1. The right won the majority of the National Assembly (AN) in December 2015; after carrying out unprecedented economic sabotage against the people.
2. Its main objective since it was installed in parliament has been to overthrow President Nicolas Maduro.
3. For this purpose, the right wing spent four months debating on the method to oust the President, considering at least the following:
a.To demand his resignation.
b.Prosecution.
c.To declare his mental disability.
d.To annulthe elections on grounds of allegedly being Colombian. e.Amendment and / or constitutional amendment to shorten his term in office.
f. The Constituent
g.Social pressure on the street. h.Recall Referendum.
4. At the end of April they decided to activate the process to requesta recall referendum.
By activating this mechanism in April instead of January when half of the presidential constitutional term was fulfilled, the right did not have time enough to carry out the recall referendum in 2016, because the terms established in the regulations states that the procedure will last more than 260 days.
To carry out this referendum in 2017 implies that to be successful, the Executive Vice President will complete the term of the revoked President, in other words it is a Chavista who will complete the presidential term until 2019.
5. In recent months, the National Assembly decided to flout the rulings of the Supreme Court that annulled its unconstitutional actions. Due to its contempt, the Court decided to annul all acts of the National Assembly until it conforms to law and respects the Constitution.
6. Nevertheless, President Nicolas Maduro has always called on the opposition to a national dialogue to resolve politically and peacefully all conflicts.
He requested the participation of UNASUR as facilitator with the participation of former presidents Zapatero, Martin Torrijos and Leonel Fernandez.
The right requested the incorporation of the Vatican as prerequisite, which was immediately accepted by President Maduro.
All attempts at dialogue have failed so far due to the internal contradictions of the opposition.
7. To call the referendum, the right must collect, first 1% of the signatures in the electoral register, in order to legitimize the political organizations promoting the referendum. Once this step has been completed, they have to collect 20% of the signatures in the register, as provided in the Venezuelan Constitution.
8. The right should collect only 195,000 signatures to meet the requirement of 1%, however it submitted 1,957,779 signatures to the CNE, which were identified in the audit where the right and the Revolution were represented, with no less than
605,727 signatures fraudulent, among which:
x 10,995 people are dead.
x 53,658 people are not registered in the Electoral Registry.
x 3,003 are under 18.
x 1,335 persons are disqualified due to serious crimes (murder, drug trafficking, robbery, fraud, sexual abuse); or
x More than 9,000 are identity theft complaints which were filed in all states.
9. Although the CNE found such irregularities, accepted by the commission appointed by the right to review signatures, it convened the collection process of 20% of the signatureson 26, 27 and 28 October, with the proviso that fraudulent registrations will be subjected to a judicial investigation.
10. On Thursday 20 October, seven national courts in different states of Venezuela, based on complaints from affected citizens, issued precautionary measures ordering the CNE to suspend all procedures that were generated as a result of the collection of 1% of the signatureson grounds of evidence of massive identity theft.
In compliance with these warrants, the CNE suspended the collection of 20% of signatures.
11. The right reacted by accusing the government of President Maduro of carrying a coup, but dodged responsibility for its leadership in fraud of 1% of signatures.
12. On Sunday 23 October the National Assembly met in an extraordinary session, openly declaring itself in "rebellion" and agreed on the following points:
To declare that President Nicolas Maduro carried out a coup and interfered the constitutional order.
To request that sanctions against Venezuela be issued by all international agencies.
To inform the International Criminal Court that the governing authorities of the CNE and judges have suspended the recall process.
To dismiss the governing authorities of the CNE and judges of the Supreme Court. To decide on the alleged dual nationality of President Maduro to dismiss him.
To decide on the abandonment of office by President Maduro to dismiss him.
13. Issues to be considered:
Who gave to the coup and to whom?
Does the right committed fraud in the collection of 1% of the signatures and the government is responsible for this?
Is the right seeking to justify a large-scale foreign intervention under the pretext of the recall suspension and an alleged humanitarian crisis?
A parliament in judicial contempt may dismiss electoral authorities or judges of the Supreme Court because they ensure compliance of the Constitution and protect the entire nation of fraud against popular sovereignty?
Is this not a case of a coup that Parliament attempts to ignore all authorities and the decisions of other public authorities, in addition to seeking his overthrow by unconstitutional means?
Colombia's Foreign Ministry sent an official note to the President of the National Assembly informing that in any agency whatsoever of his government there are no records stating that President Nicolas Maduro is a Colombian national.
Is this not the case of an attempted coup to attempt the ousting of a President with three years in office, accusing him of being a national of the country that had officially denied such accusation?
While the National Assembly is in session President Maduro is touring OPEC and non-OPEC countries entering into agreements to stabilize international oil prices, the basis of the Venezuelan economy.
Is it not a case of a coup action seeking the dismissal of a President on grounds of abandonment of office, when it is public knowledge that he is fully exercising his functions as head of state?
The people on the street will defend its Constitution, its revolution and its legitimate president.
